Different associations are formed each day to cater to some new kind of problems. Being a private organization it was formed by a private real estate developer. Although it may be operating on private terms it does not mean that is not subjected to the state policies. Different states have laws that help govern the activities of these kinds of associations, but this does not apply to all the states.

The homeowners association first came into existence during the nineteenth century. The first people who came up with the idea of forming such an organization were the land owners of the time following a number of reasons. One of these reasons was the fact that it was easy and fast to access to the highways more and more people were now able to come into the cities. This in turn grew the demand for land, which was becoming less and less due to the population growths that were being witnessed in the cities.

Basically how the whole thing works is that it grants certain privileges to the developer. This means that a developer is supposed to transfer ownership to a homeowner after the purchase has been done. In simple terms if say you wanted to acquire a home within a certain locality. You would be first required to join the association. By joining, you would be put under certain restrictions; thus, limiting your choices.

The association also enjoys certain powers. For one they may be charged with the authority of penalizing anyone who violates certain rules and regulations set in place. These kinds of penalties may come in the form of fines issued out to a defaulter. However, the resident may refuse and defend him or herself from such actions by the association.

These kinds of associations are formed to perform certain vital functions. One of them being for marketing purposes. They can do this by inviting potential buyers into the neighborhood and selling their reasons to try and convince them to buy the homes.

The other reason is to ensure that the rights of all owners are preserved. They look into the issues affecting the owners and sort out ways in which to best solve these issues. They also ensure that no rights whatsoever are violated. By making sure that the homeowners are comfortable they ensure that all interests have been properly catered for.

All the services that the residents are supposed to access should also be made available to them at all times and it is the responsibility of that body to see to this. It does not end there, they are also tasked with the duty of ensuring that all amenities reach each and every homeowner. There should be no complaints from the residents about anything as such complaints could prove to stain the reputation of property. This is an important aspect of making sure that all needs have been met and thus the market value of property is preserved.

As seen above, the benefits to be enjoyed are numerous. However, they depend with the organization in terms of how they carry out their business.
